Ultimate Fitness - Weight Loss Challenge Rules
Ultimate Fitness - Weight Loss Challenge Official Regulations. NO PURCHASE NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE'S CHANCES OF WINNING. Odds of winning will depend on the number of eligible applications received. ALL FORMS MUST BE FILLED OUT COMPLETELY AND TRUTHFULLY. FAILURE TO COMPLETE THE APPLICATION AND PROVIDE TRUTHFUL AND PERTINENT INFORMATION MAY RESULT IN DISQUALIFICATION FROM THE COMPETITION. DISQUALIFICATION IS IN THE SOLE DISCRETION OF WQAD News 8 and Local TV LLC.
WQAD News 8 will conduct the Ultimate Fitness - Weight Loss Challenge ("the Competition") substantially as described in these Regulations. Participation in the Competition constitutes each applicants' and contestant's full and unconditional agreement to, and acceptance of, these Regulations. All decisions of WQAD News 8 are final and absolute and not subject to inquiry or appeal. The Competition may be temporarily postponed or discontinued at any time without prior notice.

BACKGROUND INFORMATION: By applying for participation in the Competition, each applicant and contestant understands that he or she may be subject to one or more background checks. Background checks will include civil, criminal, financial, driver-history and any other type of background check deemed necessary by designated agents of WQAD News 8. Applicants and contestants may be required to provide additional information throughout the Competition if deemed necessary by WQAD News 8.
ELIGIBILITY REQUIREMENTS: Only one (1) application per person is allowed. Applicants and contestants must be legal US residents at least 18 years of age and reside in WQAD News 8 viewing area as defined by the Nielsen Company. To be eligible to participate, each applicant must complete an entire application package, including applicable release forms and waivers. Only printed or typed applications will be accepted. If a winner is disqualified, WQAD News 8 reserves the right in its sole discretion to determine an alternate winner or to not award that winner's prize at all. Employees of Local TV LLC, employees of WQAD News 8, Ultimate Fitness and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
CONTEST PERIOD: The Contest begins on December 19, 2011 and ends on January 22, 2012 at Midnight CT ("the Contest Period"). WQAD News 8 reserves the right to extend the Contest Period.
HOW TO ENTER: To enter, go to www.wqad.com, click on the contest icon and complete the entry form, which will include a photo and an essay as to why they should be chosen to be a part of the health challenge. Deadline for entry is January 22, 2012 at midnight CT. From January 23 to January 26, 2012, a panel from Ultimate Fitness and WQAD News 8 employees will evaluate the entries and determine which 6 (3 men and 3 women) will participate and the final 6 will be selected by January 27, 2012. Over the next 12 weeks (2/6-4/29/12), the participating individuals will work with the Ultimate Fitness trainers to put together a fitness program. They will be measured by over all health and fitness improvement, using the criteria set by Ultimate Fitness. Ultimate Fitness will use those criteria to select two grand prize winners (one male and one female) who benefited the most from the challenge.
GRAND PRIZE: The grand prize winners (one male and one female) will receive roundtrip flights to Orlando Sanford,FL and hotel stay for 2 people and a one year membership to Ultimate Fitness.
RELEASE; PUBLICITY; USE OF PERSONAL INFORMATION: By participating in the Competition, each contestant and winner waives any and all claims of liability against Local TV LLC and its employees and agents, WQAD News 8 and its employees and agents, the Competition's additional sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Competition. In order to participate in the Competition, contestants must sign an official waiver form provided by WQAD News 8. By participating in the Competition, the winner consents to WQAD News 8 and Local TV LLC's use of his or her name, state of residence, and likeness for advertising and promotional purposes online, for broadcast, and in print, or in any other media worldwide in connection with the Competition, without limitation and without additional compensation, except where prohibited by law.
TELEPHONE & DELIVERY DISCLAIMER: WQAD News 8 disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond WQAD News 8 control, or otherwise. WQAD News 8 disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. No photocopies or mechanical reproductions of entry forms are permitted. WQAD News 8 is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.
TAXES: Any valuation of the prize(s) stated above is based on available information provided to WQAD News 8, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All taxes, including federal, state and local taxes, are the sole responsibility of winner. Any person winning over $600 in prizes from WQAD News 8 will receive a 1099 form at the end of the calendar year and a copy of such form should be filed with the IRS. Each winner must provide WQAD News 8 with valid identification before any prize will be awarded.
LIMITATION OF LIABILITY: By participating, competitors agree: (a) to the Official Regulations and decisions of WQAD News 8, which shall be final in all respects; (b) to release, discharge, and hold harmless WQAD News 8 and its respective affiliates, parents, subsidiaries, advertising and promotion agencies, officers, directors, employees, representatives, and agents from all liability, injuries, losses or damages of any kind to persons, including but not limited to death or property damage resulting in whole or in part, directly or indirectly, from participation in the Competition or any Competition-related activity; (c) that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize. WQAD News 8, Local TV LLC, their sponsors, and their advertising and promotion agencies are not responsible for cancellations, postponements, or delays. WQAD News 8 shall have the sole discretion to administer the Competition and interpret and apply these Regulations. Anyone using fraudulent means to participate in and/or win the Competition will be subject to disqualification. WQAD News 8 reserves the right to disqualify any contestant at any time, for any reason, including, without limitation, language, lyrics, activities or behavior deemed inappropriate. In consideration for entering the Competition, each contestant and winner grants WQAD News 8, Local TV LLC, its sponsors and its employees, agents, subsidiaries, advertising and promotion agencies the right to use the contestant's name, voice, likeness and performance, and any portion thereof, without prior notice or compensation for any purpose and in any media now known or hereinafter devised. Such right shall be irrevocable, extend throughout the universe and inure in perpetuity. Without limiting the generality of the preceding sentence, WQAD News 8 and Local TV LLC shall own all rights, title and interest in and to all performances, recordings, videos and images rendered by contestants in connection with the Competition. Other than the prizes received by the Grand Prize winner, no contestant shall be entitled to receive any wages, benefits, fees or other compensation whatsoever as a result of participating in the Competition. In consideration for his or her participation in the Competition, each contestant agrees to release and indemnify WQAD News 8, Local TV LLC, and the officers, directors, agents, parent companies, subsidiaries and employees of WQAD News 8 and Local TV LLC, from any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that arise out of the contestant's participation in the Competition. Any expenses incurred by the applicant during the application process, including but not limited to, postage, shipping and materials preparation (videotape, photos, etc.) are the sole responsibility of each applicant and neither WQAD News 8 nor Local TV LLC will issue reimbursement for any expenses. All contestants and winners agree, by participation in the Competition, to submit to the personal jurisdiction of the courts of Illinois. All courts of Illinois shall govern this Competition, without regard to Illinois choice of law rules. The courts of Illinois shall be the exclusive forum for any dispute regarding any Regulation or activity associated with the Competition.
MISCELLANEOUS: Each applicant and contestant agrees to abide by these Regulations. Each winner must submit proof of eligibility and sign WQAD News 8 's release form to claim the prize. WQAD News 8 may substitute prizes, amend rules or discontinue the Contest at any time as announced on the Station(s). WQAD News 8 disclaims any responsibility to notify the participants of any aspect related to the conduct of the Contest.
OFFICIAL REGULATIONS: To request an additional copy of the Regulations, send a self-addressed stamped envelope to the business offices of WQAD News 8 by January 22, 2012. Written copies of these Regulations are also available during normal business hours at the business offices of WQAD News 8 at 3003 Park 16th Street, Moline, IL or online at www.wqad.com. All applications become property of WQAD News 8 and will not be returned.
COMPLIANCE WITH LAW: The conduct of the Competition is governed by the applicable laws of the United States of America, which take precedence over any regulation to the contrary herein. The Competition is void where prohibited and subject to all federal, state, and local laws and regulations.
